Last time I checked, contract law (at least in Canada) required that there be monetary or other consideration exchanged for the service/product in order for the contract to be valid and binding. Clicking the download button does not constitute a valid contract with the user and therefore the user is not bound by its terms. At least this is my view - y'all may have different opinion. To that I'll add that the site owner initially gives the impression that there are no strings attached by stating in several places on the front page that the package offered is 'completely free'. Terms are poorly defined and open to dispute.

It is a copyrighted work. Under that the owner can stipulate whatever they wish. Whether anyone accepts it or not and whether it holds in court are another thing. Unfortunately the only way to find out for sure is to test it in court.

Even if you legally use them (albeit on what sounds like a bit of a technicality) it'd be good to at least ask permission if you're going around one of the stipulations in the license. I'm quite often getting emails asking for permission to use some of my artwork, it's polite and respectful to do so.

On another note, I'm currently building some applications themes for something I'm working on, so if anyone has links to other sets of icons that are free to use I'd really appreciate them.

You could save yourself the law suite and hire a designer.

Or you could save yourself the trouble/money and read the license included with the icons, preferably from the original maker... ;)

And those famfam silk icons are very nice. that's probably why everyone uses them already.. :)

I have seen the icons, it is very lovely. i think it can be used as icon of software.
